Terms & Conditions: These are the terms on which we sell all wines and associated products to you. By ordering any of our products you agree to be bound by these Terms & Conditions. Please note that you can only purchase wines from our website in the UK if you are eligible to enter a contract and are at least 18 years old

Security: At Missing Gate Vineyard we value our customers and their security, which is why we do not store credit card details, nor do we share customer details with any third parties without permission or unless we are required to do so by law. We are committed to ensuring that your information is secure. We have electronic and physical systems in place to prevent unauthorised access or disclosure of your personal information and good procedures internally to prevent abuse.

In the process of conducting a transaction with you, some of your personal information is likely to be shared with our Bank or Booking System. In these circumstances the partner entity is legally constrained from sharing the information with any other party other than if they are compelled to by law. We will only use it to provide goods and services you have requested from us and promise to keep your personal data safe and secure. If you subscribe to our mailing list, we will from time to time send you our newsletters and special offers via email. You can change your mind about receiving our newsletters at any time by emailing us at sales@missinggate.com, or following the link to unsubscribe at the bottom of the email.

Our Privacy Policy: This Privacy statement sets out how Missing Gate Vineyard protects and uses any personal information you share with us in your use of this website and from which you may be identified. We have incorporated the new regulations arising from the General Data Protection Regulation (GDPR) into this statement and if we make any adjustments to our approach, we will always publish it here.

What we collect: During the course of a transaction we may collect the following: Name, Contact Information, including email address and/or postal address, depending on whether you are on our email and/or postal subscriber list, General location,  Preferences and interests in our products and services, Your date of birth

What do we do with this Information: We use the information you give us to ensure we understand your requirements, to deliver to any contractual obligation with you, for appropriate internal accounting and record keeping.

We may use this information to improve our offerings or services, to periodically inform you of our goods and services or of any changes we or our service providers make.

All goods remain the property of Food Physics Ltd until payment in full has been received for the wine and any other sums owed to Food Physics Ltd. The wine is to be stored securely and is to be easily identifiable as wine supplied by Food Physics Ltd.

Prices & Payment: Prices are inclusive of VAT at the rate applicable at the time of your order. The price of our products, services and any additional delivery or charges is set out on the website at the date of your order or such other price as we may agree in writing. Payment may be made by submitting your credit or debit card details with your order and we can take payment immediately or otherwise before delivery of goods.

Delivery Policy: All wine must be signed for on delivery by an adult aged 18 years or over. If no one of that age is at the address when the delivery is attempted, the goods may be retained by the delivery agent, in which case the delivery agent will leave notification of attempted delivery for the customer to rearrange delivery at a more convenient time. In these circumstances, if the company has to re-deliver the goods, a further delivery charge may become due and payable by the customer. If you are out when the courier arrives, there is the option to inform us of a safe place or a neighbour where the wine can be left. Please note that we cannot accept responsibility for any wines that have not been signed for.

Collection: If collecting your order directly from the Vineyard, you will be able to collect between 10am-4pm Monday to Friday and 10am-2pm on Saturday.

Returns/Risk: All wine shall be at the customer’s risk from the point of delivery to the customer. It is our responsibility to supply you with goods that meet your consumer rights. Upon receipt, if your order does not meet the quality expected from Missing Gate Vineyard, please contact us in the first instance to arrange a return. If the product is faulty, we will replace at no cost to yourself.

Cancellations: In accordance with the Consumer Contracts Regulations, you may cancel your order up to 14 days after receipt of the goods. Please contact Missing Gate Vineyard in writing if you wish to cancel your order or alternatively you may complete our Order Cancellation Form. If the product is faulty, we will arrange for the goods to be returned to us at no cost to yourself and for your payment to be refunded. Please note that all wine must be returned in the state that it was received. Any damage will need to be reimbursed to the company. If you have simply changed your mind after 14 days, you can return the items to us at your own cost and we will refund the cost of the wine assuming the product is in an acceptable condition for resale.

Age Restrictions: It is illegal to sell wine to anyone who is under 18 years old and the company reserves the right to refuse to accept an order if they believe this criteria not to be satisfied. By placing an order the customer is confirming they are at least 18 years old. If the company’s delivery agents are in any doubt about the age of the recipient on delivery, they will request some form of ID. If the person receiving the goods is unable to produce appropriate ID, unfortunately our delivery agents will be unable to leave the goods.

Complaint Handling Policy: We always aim to provide the highest standard of care in all our services and quality of our wines. Our customers’ views are important to us and help to ensure our products and services are consistently meeting people’s needs. If you are unhappy with any of our products and services, it is important that you let us know.

Vineyard Tours & Tastings: By joining a tour at Missing Gate Wine Estate, you acknowledge that participation involves inherent risks associated with a working vineyard environment. These may include uneven ground, varying weather conditions, encounters with wildlife or insects, and extended walking or standing. While we take all reasonable precautions to ensure your safety, participation is at your own risk. Missing Gate Wine Estate, its owners, staff, and affiliates are not liable for any injury, illness (including COVID-19), loss, or damage sustained during your visit, whether arising from negligence or otherwise. By taking part, you accept full responsibility for your safety and well-being. You also consent to emergency medical treatment if required, with any resulting costs being your responsibility. Unless you inform us otherwise in advance, you grant permission for any photos or videos taken during the tour to be used for promotional purposes by Missing Gate Wine Estate.
